A federal judge in Utah recently ruled that state anti-gambling regulations apply to Kalshi’s sports prediction contracts. US District Judge Robert J. Shelby issued the summary judgment in favor of Utah, rejecting the operator’s claim that federal commodities law overrides local statutes.
Legal Preemption and Federal Oversight
The court determined that the Commodity Exchange Act does not preempt Utah’s authority to regulate gambling. Judge Shelby noted that Congress did not intend to strip states of their traditional oversight when expanding the CEA through the Dodd-Frank Act. Under Section 16(e)(2) of the statute, federal preemption applies only in specific situations that do not cover Kalshi’s event-based contracts.Compliance Requirements and Appeal Plans
Kalshi previously argued that state restrictions conflict with Commodity Futures Trading Commission rules mandating impartial market access. The ruling states the company did not demonstrate that dual compliance is unworkable, pointing out that Kalshi already limits participation in select contracts through its own terms. The decision concludes the district court phase, though Kalshi plans to appeal to the Tenth Circuit Court of Appeals.Similar litigation in Minnesota, Nevada, Michigan, and New York has so far produced preliminary injunction rulings rather than final judgments. Utah Attorney General Derek Brown stated: "You can’t rebrand illegal gambling as a federal commodity, and today a federal judge agreed with us. Kalshi bet that clever branding would beat Utah law.
